GENERAL TERMS AND CONDITIONS
1.GENERALITY.
These General Terms and Conditions (hereinafter “GTC”) apply to all Courses provided by the Italian Pizzaioli Society (hereinafter SIP). The GTC may be supplemented or modified by specific subsequent provisions that take precedence over the previous ones. The Student is required to read these GTC, which are understood to be accepted in full by signing the application for admission to the chosen Course.
2.DEFINITIONS.
In the context of these GTC, the following capitalized terms shall have the meanings respectively assigned below:
-Pupil: the person who signs the application for admission to the course, as identified by the master data entered in the relevant form of;
-SIP: Scuola Italiana Pizzaioli S.r.l., located at 1 Via Zilioli, 43011-Busseto (PR), which delivers the course pre-selected by the Student;
-Billing details: party (p.f./p.g.) who makes the payment and to whom the relevant invoice will be issued once SIP has collected the price of the Course;
-Course(s) chosen: training activity as specifically organized and scheduled by SIP and identified by the Student on the admission form;
-POF: Educational Offer Plan
3.OBJECT OF THE CONTRACT
Upon SIP’s acceptance of the application for admission to the chosen Course, the Student will be able to attend the same once the price established for each specific Course has been paid. Registration for the identified Course is valid for the session established and scheduled as per the Course calendar provided by SIP.
4. OBLIGATIONS OF SIP
4.1. SIP undertakes to organize and carry out, consistent with the application, the required Basic and Specialized Training Courses, making use of specialized professional instructors, called Master Instructors P.F.C. and providing for these purposes the raw materials and tools necessary for the conduct of the classes, in compliance with the standards set forth in the HACCP protocol.
4.2. SIP also provides the Student with the educational materials pertaining to the Course, delivering what is necessary for the proper conduct of the Course, such as the course manual, the POF (Educational Offer Plan), handouts and/or other media made in electronic and/or paper format.
5. OBLIGATIONS OF THE STUDENT
5.1. The Student, by signing the application for admission, undertakes to provide SIP with all the data and information necessary for the proper management of the required Courses, reporting in particular any food allergy and/or intolerance as well as any disability and/or illness in any case relevant to the management of the Course.
5.2. The Student is obligated to pay the price for the chosen Course in full no later than the first day of the Course.
5.3. The Student also undertakes to behave in a manner appropriate to the place in which the lessons are held so as not to impede the proper conduct of the lessons, adhering strictly to the rules of conduct and safety provided by SIP, avoiding any behavior or attitude that may disrupt the regular conduct of the lessons or endanger his or her own safety or that of third parties. The Student agrees to use only the materials and equipment provided by SIP using them with the utmost care and diligence and finally to follow the directions given by the Master Instructor and not to perform in any way all activities that are strictly reserved for the latter.
6. ADMISSION AND COURSE REGISTRATION
6.1. Only people over the age of 16 will be eligible for the Courses.
6.2. The Student applies for admission to the course by means of filling out the application form, duly completed in its entirety and signed, as well as payment of the participation fee as regulated in Section 9 of these GTC. Once the Student has made the Course selection with application for admission, he/she may no longer change his/her choice, subject to the provisions of Art. 10.
6.3. SIP reserves the right to evaluate the application for admission to the Courses; consequently, enrollment will be finalized only upon acceptance of the Student’s application by SIP.
7. LOCATIONS, DATES AND COURSE OF CLASSES
7.1. SIP will prepare the calendar indicating the date, times and locations of the individual Courses, doing its best to keep them unchanged and reserving in any case the right to postpone the classes for a better organization of the same, modifying the program but maintaining in any case the continuity and quality of the same and informing the Student accordingly.
7.2. Classes will be held in groups and will be held at SIP locations, on scheduled dates as per the schedule prepared by SIP.
8. MINIMUM NUMBER OF PARTICIPANTS
It should be noted that SIP will conduct the Courses if a sufficient number of enrollments is reached for the activation of the same. If the minimum number of enrolled students is not reached, SIP reserves the right to cancel the relevant Course, providing for the reimbursement of the full amount punctually paid by the Student, or alternatively to reorganize a new Course at a later date, giving the Student adequate notice.
9. TERMS AND CONDITIONS OF PAYMENT
9.1. The price of the Course, indicated in the application for admission, shall be paid no later than the first day of the Course, in one lump sum, exclusively by bank transfer (within the maximum limits stipulated by law), with issuance of the receipt/invoice once the payment is collected.
9.2. Delay or deferment of payment of the price is not allowed, under penalty of exclusion from the classes, without prejudice, however, to the amount owed by the Student.
10. MAJOR FORCE.
10.1. SIP will not be liable for any delay and/or cancellation of individual classes and/or Courses due to force majeure, which is not the fault of SIP and/or the Master Instructor. By way of example only, events such as the malfunctioning of instruments/equipment necessary for the conduct of classes (such as ovens, electrical system etc.), sudden interruption of electricity/drinking water supply by the supplying company, non-supply of raw materials not communicated in time to SIP by third-party suppliers, pandemics, natural events, strikes are considered force majeure. In such cases, there are no refunds, discounts or price reductions, without prejudice to the possibility for the Student to attend rescheduled classes or, where possible, to have the Student participate in the class or Course electronically.
10.2. If the duly enrolled Student is unable to attend the classes, even as a result of any rescheduling by SIP with a change in the schedule, the classes cannot be made up, and SIP will not provide any refund, discount or reduction in price.
11. DISCLAIMER OF LIABILITY
11.1. The Student, except in cases of willful misconduct and gross negligence, expressly exonerates SIP from any liability, including to third parties, for direct and indirect damages resulting from the use of the information acquired during the lessons.
11.2. The Student exonerates SIP from any liability connected with or related to conduct of the Master Instructor held during the Courses that is unsuitable and inconsistent with SIP’s directives, including with respect to the manner of use of the raw materials provided.
11.3. The Student acknowledges the risks due to the use of the instruments present in the classrooms where the courses are held and also releases SIP from all liability for any damage caused to himself or to third parties as a result of the improper use of the instrumentation and materials made available (e.g., ovens and heat sources, shovels, knives, etc.), as well as for any injuries resulting from the violation of the rules of conduct described in these GTC.
11.4. SIP will also not be liable for any damages, losses, and costs that may be incurred by the Student as a result of the delay and/or cancellation of classes and/or Courses due to force majeure as stated in Art. 10.
12. PROCESSING OF PERSONAL DATA
The personal data of the Student are processed by SIP, as the Data Controller, in accordance with the relevant regulations European Regulation 2016/679 (GDPR) and Privacy Code D.Lgs. 196/2003 s.m. from D.Lgs. 101/2018, as better specified in the information released pursuant to Articles 12,13,14
GDPR.
13. APPLICABLE LAW AND EXCLUSIVE FORUM
These GTC are governed by and shall be construed in accordance with Italian law. All disputes arising between the Student and SIP concerning the Courses and these GTC shall be the exclusive jurisdiction of the Court of Parma
